1. Eligibility and Account Registration

• Age Requirement: You must be at least 13 years old to use our Service. Users between 13–17 years old must have parental consent.

• Account Responsibility: You are responsible for all activities under your account. Notify us immediately of any unauthorized use.

2. Subscription Services

2.2 Subscription Billing

• Automatic Renewal: Subscriptions renew automatically unless cancelled before renewal.
• Payment Processing: Payments are processed via your Apple App Store or Google Play account.
• Price Changes: We may change prices with 30 days’ advance notice, effective at your next renewal.
• Billing Cycle: Charges occur at the start of each period; no refunds for partial periods.

2.3 Free Trials

• Some subscriptions may include a free trial.
• Cancel before the trial ends to avoid charges.
• Eligibility may be limited to one per user.

2.4 Subscription Management and Cancellation

• Cancellation: Cancel anytime via your App Store or Google Play settings.
• Timeline: Cancel at least 24 hours before the next renewal date.
• Access After Cancellation: You retain premium access until the current period ends.
• No Refunds: No refunds for unused portions, except as required by law.

2.5 Subscription Restoration

If you reinstall the app or use a new device, you can restore your subscription using your original App Store or Google Play account.

3. Account Deletion and Data Retention

3.1 Account Deletion

• You may request account deletion at any time by contacting us at [email protected].
• Deletion permanently removes your profile, progress data, and personalized content.
• Subscription cancellation does not automatically delete your account.

3.2 Data Retention After Deletion

• Most personal data is deleted within 30 days of your request.
• Some data may be retained for legitimate business purposes as outlined in our Privacy Policy.
• Anonymized usage data may be retained for analytics.

6. Intellectual Property

• Our Content: All content is owned by Meditation LLC or licensors and protected by IP laws.
• Limited License: Personal, non-commercial use while your subscription is active.
• User Content: Feedback/suggestions may be used by us without restriction or compensation.

7. Service Availability and Modifications

• Availability: We strive for uptime but do not guarantee uninterrupted access; maintenance may occur; we are not liable for interruptions beyond our control.
• Modifications: We may modify, suspend, or discontinue parts of the Service with reasonable notice.

8. Disclaimers and Limitation of Liability

8.1 Medical Disclaimer

• The Service is not a substitute for professional medical advice, diagnosis, or treatment.
• Consult healthcare professionals if you have medical concerns.
• No medical benefit claims are made.

8.2 Service Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDITATION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless Meditation LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

10. Dispute Resolution

• Governing Law: Wyoming, USA, without regard to conflict of law principles.
• Arbitration: Binding arbitration per AAA rules in Wyoming.
• Class Action Waiver: Disputes resolved individually; class actions waived.

11. iOS Minimum Terms for Custom EULA

The following provisions apply if you are accessing or using our mobile app on an Apple Inc. (“Apple”) branded mobile device. These Terms, including this section, constitute a custom EULA for any Soothe Senses mobile app for purposes of Apple’s agreements and you acknowledge that Apple’s standard EULA will not apply.

12. Termination

• By You: Terminate anytime via account deletion or by contacting us.
• By Us: We may suspend/terminate accounts for violations or harmful conduct.
• Effect: Access ceases immediately; account data may be deleted.

13. General Provisions

• Changes to Terms: We may modify Terms at any time; material changes will be communicated via app or email with at least 30 days’ notice. Continued use constitutes acceptance.
• Severability: If any provision is unenforceable, remaining provisions remain in effect.
• Entire Agreement: These Terms and our Privacy Policy form the entire agreement.
